Making Up Fasts

Question: Assalam alaykum

Last Ramadan, I missed 10 fasts due to an illness. Do I have to make
them up before this coming Ramadan 2019 and will I be sinful if I
don`t?

Answer: Wa alaikum assalam wa rahmatullah,

No, you do not need to make up your missed fasts from last year before this Ramadan.

Though it is ideal and proper to take care of your missed duties right away, especially in the case of remissness, there is no penalty for delaying them. Accordingly, fasting voluntary fasts would be acceptable.

Of course, it would be superior to fast the makeups (qada’) before the subsequent Ramadan if possible, in lieu of the difference of opinion on the matter, but it is not binding to do so.

Does Licking My Lips Invalidate My Fast?

Question: Assalam’aleykum,

If one licks the lips once, and then immediately licks them again, does this invalidate the fast?

Answer: Wa alaikum assalam wa rahmatullahi wa barakatuh,

I pray that you are in the best of health and faith, insha’Allah.

No, licking your lips and then doing so again deliberately is excused and does not break your fast because it is deemed to be difficult to avoid. This is understood from the words of the jurists in discussing similar issues.

But in general you should avoid this as some considered it to be invalidating. Of course, this would only be in the case that you are certain that you swallowed the saliva from your lips. Misgivings and doubts are ignored, and they do not lift the operational certainty of validity and soundness.

في مراقي الفلاح: في الخانية ترطب شفتاه ببزاقه عند الكلام ونحوه فابتلعه لا يفسد صومه اهـ.
وفي حاشية الطحطاوي على الدر: قوله: (ونحوه) كعادة وذكر اهـ.
وفي الفتاوى الهندية: تَرَطَّبَتْ شَفَتَيْهِ بِبُزَاقِهِ عِنْدَ الْكَلَامِ أَوْ غَيْرِهِ فَابْتَلَعَهُ لَا يَفْسُدُ لِلضَّرُورَةِ كَذَا فِي الزَّاهِدِيِّ اهـ.
وفي الدر المختار: وكذا لو فتل الخيط ببزاقه مرارا وإن بقي فيه عقد البزاق إلا أن يكون مصبوغا وظهر لونه في ريقه وابتلعه ذاكرا اهـ.
وفي رد المحتار: قوله: (وكذا لو فتل الخيط ببزاقه مرارا الخ) يعني إذا أراد فتل الخيط وبله ببزاقه وأدخله في فمه مرارا لا يفسد صومه وإن بقي في الخيط عقد البزاق اهـ.
وفي المحيط البرهاني: وعن الفقيه أبو جعفر أنه إذا أخرج البزاق على شفتيه، ثم ابتلعه فسد صومه. اهـ.
