Must the Kaffara Be Completed First or Qada’?

Hanafi Fiqh

Answered by Mawlana Ilyas Patel

Question

If a person owes both qada’ and kaffara fasts, must the kaffara be completed first?

Does eating after Fajr adhan out of ignorance require kaffara or just qada’?

If uncertain about how many fasts were missed, should one assume all fasts from age 15 until learning the rulings?

Answer

In the Name of Allah, the Most Merciful and Compassionate.

I pray you are in good faith and health.

If a person owes both makeups (qada’) and expiations (kaffara), it is superior to begin with the qada’, as it is obligatory (fard).

Eating after the Fajr adhan does not require expiation (kaffara); it only necessitates a makeup (qada’) fast.

If you are unsure about how many fasts were missed since reaching puberty (bulugh), then you should estimate the number of fasts from that period onward. [Ibn ‘Abidin, Radd al-Muhtar; Shaykhzadah, Majma al-Anhur fi Sharh al-Multaqa al-Abhur]
