If I am permitted to use dry ablution (tayammum) but have impurity on me beyond the excused amount, must I remove it before praying?
Answer
In the name of Allah, the Most Merciful, the Most Compassionate.
Yes. If you can remove it, do so before praying. Dry ablution stands in for washing the limbs; it does nothing to physical filth on your body, your clothes, or the place where you pray. Purification from the ritual state and purification from filth are two separate conditions of a valid prayer in the Hanafi school, and being excused from the first does not touch the second.
The Excused Amount Is a Dirham of Heavy Filth
Within that amount, you may pray; beyond it, you may not. Imam Shurunbulali (Allah have mercy on him) states it plainly: “The amount of a dirham of heavy filth is excused.” [Shurunbulali, Maraqi al-Falah, 1.65] So the question is not whether you are praying with earth or with water. It is whether what is on you exceeds that amount, and whether you have the means to wash it.
If Your Water Is Enough for Only One Purpose, Spend It on the Filth
Imam Kasani (Allah have mercy on him) gives the case directly: “A traveler in a state of ritual impurity, on whose garment is filth greater than the measure of a dirham, and who has with him water enough for only one of the two, washes the garment with it and performs dry ablution for the ritual state, according to the generality of the scholars.” [Kasani, Badaʾiʿ al-Sanaʾiʿ, 1.57] His reason: “directing it to the filth makes him one who prays with two purifications, the actual and the legal, so that is better than praying with a single purification.” [Kasani, Badaʾiʿ al-Sanaʾiʿ, 1.57]
The Messenger of Allah (Allah bless him and give him peace) said, “The clean earth is the ablution of the Muslim, even for ten pilgrimage seasons …” [Bayhaqi, al-Sunan al-Kubra, 1.326] Notice what the earth replaces: the ablution. Filth is washed off instead, and not with water only. Imam Quduri (Allah have mercy on him) writes, “It is permitted to purify filth with water and with every pure liquid by which its removal is possible, such as vinegar and rose water.” [Quduri, Mukhtasar al-Quduri, 1.21]
That washing is meant to be unburdensome. When a bedouin urinated in the mosque, the Prophet (Allah bless him and give him peace) told the people, “Leave him, and pour over his urine a bucket of water, or a pail of water, for you were sent only to make things easy, not to make them hard.” [Bukhari]
If You Genuinely Cannot Remove It, Pray as You Are
No water, nothing else that would lift it, no clean garment to change into: then you pray with the filth, your prayer is valid, and you owe no repetition. Imam Shurunbulali writes: “One who lacks the means to remove filth prays with it and owes no repetition, and neither does one who lacks what would cover his nakedness.” [Shurunbulali, Maraqi al-Falah, 1.90] Imam Tahtawi (Allah have mercy on him) glosses it: “One who lacks the means to remove preventive filth prays with it and owes no repetition, because accountability is according to capacity.” [Tahtawi, Hashiyat al-Tahtawi, 1.238] Do not let the prayer leave its time while you look for a remedy.
Water Goes First to the Filth, Earth Stands In for the Ablution
Hold the two purifications apart, and the matter settles: earth substitutes for the ablution, filth is washed off wherever you have something that lifts it, and where you have no means to remove it, you pray as you are and owe no repetition.
