Does Living Together After Divorce Affect the Validity of a New Marriage?

Question

Suppose I waited more than the three-month waiting period after being Islamically divorced. In that case, the husband came to live in the house as a roommate for a few months, and then we were legally divorced in the USA, and I got remarried. Is the new marriage valid?

Answer

In the Name of Allah, the Most Merciful and Compassionate.

The new marriage contract is valid in your situation. Once the waiting period (‘idda) after the Islamic divorce is completed, the previous marriage is entirely annulled. As Allah (Most High) states:

“And when you divorce women and they have fulfilled their term (‘idda), either keep them according to reasonable terms or release them according to reasonable terms.” [Quran, 2:231]

After the waiting period, the previous marital bond is dissolved, and you are free to remarry. It is important to note that while living together as roommates during that time was unlawful, the key point is that the marriage contract itself has been nullified after the ‘waiting period, and your new marriage is valid and separate from the prior one.

To maintain our connection with Allah (Most High) and to receive blessings (baraka) in our lives and relationships, it is essential to follow Sacred Law and conduct our relationships in a way that is pleasing to Allah (Most High), especially by avoiding situations that could lead to unlawful interactions.

May Allah (Most High) guide us all to act in accordance with His laws, protecting the honor and dignity of every individual.
