What Is the Ruling If a Man Touches His Sister with Lust?

Hanafi Fiqh

Answered by Mawlana Ilyas Patel

Question

Will a married man’s lustful touch on his sister’s buttocks and breasts, as well as rubbing his private part on her buttocks (with clothes on) until he ejaculates, nullify his marriage with his wife?

Bearing in mind that there was no actual touching of the private parts outside of the clothes.

Answer

In the Name of Allah, the Most Merciful and Compassionate.

I pray you are in good faith and health.

Ruling

As mentioned above, if a married man touches his sister desirously, it is a grave sin. However, one ‘s wife will not become forbidden upon him.  He should deeply and sincerely repent and seek forgiveness profusely. [Ibn ’Abidin, Radd al-Muhtar]

Repentance and Seeking Help

One should continue to repent and seek forgiveness. Ibn Umar (Allah be pleased with him) reported: The Messenger of Allah, peace and blessings be upon him, said, “O people, turn to Allah in repentance. Verily, I repent to Him one hundred times in a day.” [Muslim]

We should always maintain decency in dress and conduct – for both men and women – within the family, too. If one has thoughts about family members, one needs to repent, seek Allah’s forgiveness from any active thinking with desire about them, and if one struggles, immediately seek qualified counsel from scholars, as the personal or familial harm of such desires is devastating for all.
