Is My Marriage Valid If I Married With an Imam as a Guardian Without My Father?

Hanafi Fiqh

Question

Is my marriage valid if I married with an imam as my guardian, without my father’s consent?

Answer

In the Name of Allah, the Merciful and Compassionate.

There are a few considerations in this matter.

The Validity Depends on the Details

If the imam who acted as guardian was learned and qualified, then the marriage may well be valid. However, the specifics of your situation matter, and the ruling depends on the details of how the marriage was conducted and whether all necessary conditions were met.

For this reason, you should take the full details of your case to a qualified scholar who can review the scenario and confirm whether what was done was correct.

The Importance of Parental Approval and Guardian Participation

In general, one should not marry without the approval of one’s parents. This applies to both men and women in the general case. With women in particular, the permission and participation of the guardian is essential.

The Prophet (Allah bless him and give him peace) said,

“There is no marriage without a guardian.”

The Hanafi school understood this to mean that there is no proper marriage without a guardian, and thus did not consider it a factor in determining validity. Even so, it remains contrary to the Prophetic sunna and example to marry without the approval and participation of one’s parents.

Marrying without parental involvement may also entail the grave matter of being bad to one’s parents, which can be a major sin.

Rectifying the Relationship With Parents

If your parents were not involved, and the marriage was nevertheless valid because the other criteria were fulfilled, then your responsibility is to work to win over your parents. Life can be difficult, and relationships can become strained, but it is essential to commit to taking steps to rectify the relationship with one’s parents.

And Allah is the giver of success and facilitation.
