Hanafi Fiqh

Question

What are the recommended introductory books on Usul al-Fiqh?

Answer

I pray you are well.

First and foremost, you need a teacher. I assume you will be studying Usul al-Fiqh with a teacher, as the field is complex and requires a broad understanding of the Shari‘a.

Without that broad grounding, a person may read passages and feel that they do not make sense.

A Common Starting Text in Many Places

In many places, students usually begin with texts such as Mukhtasar al-Manar, along with the commentary by Qasim ibn Qutlubugha.

If you have a teacher explaining it, it is an excellent first text.

Usul al-Fiqh is studied through different approaches:

The Hanafi Approach

The Hanafi approach examines the specific issues and answers Abu Hanifa gave, then derives the principles from them.

In other words, it looks at the final product, meaning the legal ruling, and then works backwards to arrive at the methodology.

The Approach of the Other Three Schools

The approach of the other three madhhabs first considers wider principles and then filters them down to arrive at answers.

This is essentially a reversed approach.

Al-Mujaz by Ubaydullah al-As‘adi

One of my late Usul al-Fiqh teachers, Shaykh Adnan Darwish (Allah have mercy on him), used to recommend a text by Ubaydullah al-As‘adi called al-Mujaz.

It is taught here on SeekersGuidance (Understanding Hanafi Usul al-Fiqh: al-Asaadi al-Mawjiz fi Usul al-Fiqh), and it is an excellent introductory text.

As‘adi’s approach helps with the Hanafi understanding, and it can also benefit a student with the other approach.

Other Simplified Works

There are also other books that have been simplified.

Dr. Salah Abu al-Hajj has written a couple of works on Usul al-Fiqh. He has one related to Mukhtasar al-Manar, and he also has a shorter work, Sabil al-Usul, or something similar, ila ma‘rifat al-Usul.

That is the one I would recommend.

Usul al-Shashi and the Need for Preparation

Usul al-Shashi is also good, if studied with a teacher. However, Usul al-Fiqh is not a science that you jump into expecting clarity from day one, especially if you have not studied other texts.

That is why, generally, covering a book in furu‘, such as Mukhtasar of Imam Quduri, and learning the broad and main topics in each chapter of fiqh, helps a great deal.

And Allah knows best.
