Is Expiation Required for Late Ihram?
Hanafi Fiqh
Answered by Shaykh Yusuf Weltch
Question
I traveled from the Levant to Mecca for ‘Umra but delayed entering ihram until reaching Masjid ‘A’isha. I later learned this may not be the correct miqat. Is my ‘Umra valid, and do I owe expiation for this mistake?
Answer
In the Name of Allah, the Most Merciful and Compassionate.
The Messenger of Allah (Allah bless him and give him peace) said,
“Do not pass the Sacred border (Miqat) except in the state of Ihram.” [Tabarani]
The Sacred border (miqat) for the people of the Levant (or Greater Syria) is al-Juhfa, a position about 190 kilometers northwest of Mecca. [Ibn ‘Abidin, Radd al-Muhtar]
If one passes this border without being in the state of Ihram, they can make up for the violation by exiting and entering from any of the Sacred border entry points. This will absolve them of any need for expiation. [Ibid.]
Hope this helps
