Do Conditional Statements Constitute Divorce?

Hanafi Fiqh

Answered by Mawlana Ilyas Patel

Question

My husband frequently imposes conditional statements like, in  or “If you don’t sit here, you are haram for me.” Do such statements affect our marital relationship?

Answer

In the Name of Allah, the Most Merciful and Compassionate.

I pray you are in good faith and health. Thank you for your question.

The above are conditional statements; divorce will result if the above actions do not occur.

If a husband conditions a divorce on a future event—such as stating that his wife will be divorced if she enters the house—then the divorce will take effect when that condition is met.

Imam Mawsili (Allah have mercy on him) states: “If one tied the divorce to (the occurring) of a condition, divorce will be effected when the condition takes place. And the oath will end with the divorce because when the condition (i.e., the act) takes place, the oath no longer remains.” [Mawsili, al-Ikhtiyar li Ta’lil al-Mukhtar, Ibn ‘Abidin, Radd al-Muhtar]

Conditional Divorce

Divorce is a serious issue, and our religion imposes significant consequences for casually mentioning it, especially in a conditional manner like the above.

Individuals need to remain calm and composed when communicating with their spouses, avoiding using the word “divorce” carelessly or hastily. Ultimately, haste is a tool of the Shaytan, while careful, calm consideration is a virtue from Allah, as stated by the Prophet (Allah bless him and give him peace).

Given the considerations in such cases, please consult reliable local scholars about the specifics of the situation. Jazakum Allah khayr.
