What Is the Ruling on Buying Something “As Is”?

Hanafi Fiqh

Answered by Shaykh Yusuf Weltch

Question

I was wondering what is the ruling on buying an item/vehicle in an “as is” condition.

Answer

In the Name of Allah, the Most Merciful and Compassionate

Buying something “as is” is an Islamically sound business contract. [Maydani, al-Lubab fi Sharh al-Kitab]

The only ruling that arises from such a condition is that the buyer does not have the option of cancellation if they later find a flaw in the sale item. By agreeing to an “as if” sale, they are essentially waiving their right to cancellation if a flaw is later discovered in the sale item. [Ibid.]

Hope this helps
