Can a Muslim Stay Married to an Agnostic Spouse?

Hanafi Fiqh

Answered by Mawlana Ilyas Patel

Question

I embraced Islam after marrying a Hindu woman while we were both agnostics. She remains agnostic but is supportive. Is it permissible to remain in this marriage, and is there a middle ground Islamically in such a situation?

Answer

In the Name of Allah, the Most Merciful and Compassionate.

I pray that you are in good faith and health. Thank you for your question. May Allah Most High accept your Islam and make it a means for all good in your life and for her acceptance of Islam.

It is not permissible to stay married to a non-believer or an agnostic. [Al-Fatawa al-Hindiyya]

The middle ground is simply this: you should keep working on her accepting Islam. She can enter it by believing in Allah’s oneness and the prophethood of our Prophet. Gradually, she can practice the other aspects of Islam later.

Speak and consult local, reliable scholars and practicing Muslims to help and support you to find ways to work on how she can accept Islam and pray to Allah for her guidance and goodness (khayr) in your life.

May Allah (Most High) grant you what is good. Seek guidance through Istikhara and pray the Prayer of Need, and regularly ask Allah (Most High) to destine what is good (khayr) for you daily.

Given these considerations, we urge you to consult reliable local scholars regarding the specifics of your situation. May Allah grant you ease and all that is good.
