Can a Pregnant Woman Leave an Abusive Husband During Her Waiting Period (‘Idda)?

Question

May a pregnant woman leave her husband and return to her home country due to emotional abuse and an inability to safely remain with him during her waiting period?

Answer

In the Name of Allah, the Most Merciful and Compassionate.

May Allah alleviate our difficulties and guide us to what pleases Him. Amin.

This is a delicate situation. It is important to balance the sanctity of marriage with the need to protect life and dignity.

The First Step: Seeking Resolution

At first, it is best not to leave the marital home quickly. Try to resolve the situation through the right steps.

Allah (Most High) says:

“If you fear a breach between them, appoint an arbiter from his family and an arbiter from hers…” [Quran 4:35]

This verse teaches us the importance of seeking help. Especially from trusted elders, family members, or local scholars, who can help mediate and assess the situation.

This Divine prescription is the wiser choice. Hopefully, it can bring about lasting change, accountability, and, in sha Allah, a chance for reconciliation.

When Harm Is Real and Present

However, if staying in the home puts you at real risk, either physically or emotionally, the situation is different.

Allah (Most High) says:

“Do not harm them so as to oppress them…” [Quran 65:6]

And the Prophet (Allah bless and give him peace) said:

“There is to be no harm nor reciprocating harm.” [Ibn Maja]

In this case, protecting your life and well-being, as well as your unborn child’s, comes first. If staying puts you in real danger, you may leave to keep yourself safe.

At the same time, remember to respect Sacred Law and do only what is necessary to preserve life. If you must leave, do so carefully and, ideally, with the help, protection, and advice from trusted people or authorities.

I pray that Allah gives you protection, clarity, and a path forward filled with mercy and wisdom.
