Can a Shafi‘i Woman Marry Without Her Guardian?

Question

I am Hanafi, and I married a 20-year-old Shafi’i woman in Indonesia. She agreed freely; we had an imam, two witnesses, and the full mahr.

However, we did not get her father’s permission because he had cut off all contact, and we did not seek a wali hakim. Is our marriage valid, and what should we do now?

Answer

In the name of Allah, the Most Merciful and the Most Compassionate.

According to the Hanafi school, your marriage is valid as long as you are a suitable match (kafa’a) for her. In Hanafi law, an adult woman can marry with her own consent in front of witnesses [Ibn Abidin, Radd al-Muhtar].

However, under Shafi’i law, the marriage is invalid because a guardian is required for the contract. If the father is unavailable, guardianship should go to a judge or religious authority (hakim) and not be skipped [Nawawi, Minhaj al-Talibin; Shirbini, Mughni al-Muhtaj].

The Prophet (may Allah bless him and grant him peace) said, “A woman’s marriage is invalid if she marries without her guardian’s permission,” and in the same hadith it is stated that “the ruler is the guardian of someone who has no guardian.” [Abu Dawud; Tirmidhi; Ibn Maja]

If a father blocks all contact, his daughter can still marry. In this case, guardianship passes to the religious authority after you have made reasonable efforts to reach him and have recorded those attempts.

Because this step was possible but not taken, your marriage is now affected by the difference between the two schools.

The main principle is that your marriage should be free of doubt.

To ensure this, you should renew your marriage contract (tajdid al-nikah) as soon as possible through the wali hakim. In Indonesia, this is done at the Office of Religious Affairs (KUA).

The process is quick, meets the requirements of both schools, and protects your wife and any future children. Keep trying to contact her father kindly, and keep a record of your efforts.
