Is Divorce Under Coercion Valid?

Shafi'i Fiqh

Answered by Shaykh Irshaad Sedick

Question

My wife’s family has been threatening my life to divorce her. They forced me to sign divorce papers, or they would kill me. Was that divorce valid?

Answer

In the Name of Allah, the Most Merciful and Compassionate. May Allah alleviate our difficulties and guide us to what pleases Him.

Based on your description, this was a coerced divorce. Coerced divorces are not valid according to sacred law, and Allah knows best. [Nawawi, al-Minhaj]

Given the considerations in such cases, we urge you to please consult reliable local scholars or counselors about the specifics of the situation.

May Allah protect you and your family.

I pray that this is of benefit and that Allah guides us all.
