Is Gold Spot Trading Permissible When Bank Settlement Takes One Extra Day?
Hanafi Fiqh
Answered by Shaykh Faraz Rabbani
Question
Is it permissible to buy and sell gold on a spot basis when the sale completes immediately, but the payment reaches the seller’s bank account a day later due to administrative bank processing?
Answer
In the Name of Allah, the Merciful and Compassionate.
Yes, this is permissible. When the buyer’s payment is irrevocably committed at the time of sale, the account is debited, the transaction is confirmed, and constructive possession (qabd hukmi) has occurred. An administrative processing delay is not a deferred payment.
Gold as an Interest-Prone Commodity
Gold is an interest-prone (ribawi) commodity. Islamic law requires that its sale for money be immediate: a hand-to-hand exchange (yadan bi yadin), with both parties effectively in possession before they part.
The Prophet (Allah bless him and give him peace) said: “Gold for gold, like for like, hand to hand — whoever adds or asks for more has engaged in usury (riba).” [Bukhari; Muslim]
What Does Hand-to-Hand Mean?
“Hand to hand” does not mean physical coins in the same room. In the Hanafi school, constructive possession (qabd hukmi) suffices — control transfers effectively, even if physical movement takes a moment. [Ibn ‘Abidin, Radd al-Muhtar, Bab al-Sarf]
When a buyer pays electronically, and the account is immediately debited, the seller’s right to that amount is established then and there. The bank’s overnight clearing cycle is an administrative formality. It is a universal feature of modern banking — not a genuine deferment of payment. [Taqi Usmani, Fiqh al-Buyu‘]
What would make a transaction impermissible is genuine deferred payment: an agreement to pay tomorrow, or a credit purchase. That is not what is described here. The sale completes immediately. The money moves immediately. The clearing is a technicality.
The Reliability of Immediate Commitment
It is blessed that you are seeking knowledge and clarity before transacting. This is the way of the mindful Muslim trader. Be grateful: our religious guidance has the juristic tools to meet the realities of our time.
And Allah knows best.
