Can a Hanafi Marriage Be Valid Without Parental Consent?

Question

I am Hanafi and married without my father’s consent. He later told my husband to stop speaking to me. Can my father invalidate our marriage because it was done without his permission?

I pray you are in good faith and health. Thank you for your question.

If you married a suitable, upright suitor, albeit sinful, without your father’s consent, the marriage will be valid. He cannot invalidate it.

In the Hanafi School, a marriage without a guardian’s approval (wali) is only valid if the person she is marrying is legally considered a suitable match (kafa’a). Was this the case?

According to the famous relied position in the Hanafi School, a woman’s marriage without the approval of her guardian (wali) is only valid if the person she is marrying is legally considered a suitable match (kafa’a).  This is the position adopted by the overwhelming majority of the Hanafi fuqaha. [Ibn ‘Abidin, Radd al-Muhtar; Maydani, al-Lubab fi Sharh al-Kitab]

Seek Forgiveness

Seek profound apologies and ask for forgiveness. Treat your parents with kindness, even though they might be temporarily displeased. They have a right to do so. It heals with time.

Seek forgiveness from Allah, too, for displeasing your father. However, don’t be despondent, as long as your husband is an upright suitor, and also ask your husband to do the same to treat and do his best to serve and respect your parents.

We are not perfect beings, and you should not expect perfection from yourself. Allah loves the repentant, as the Prophet told us (Allah bless him and give him peace),

“All the sons of Adam are sinners, but the best of sinners are those who are given to repentance.” [Tirmidhi; Ibn Maja]
