What Is the References on Wearing Underwear in Ihram for a Need?

Hanafi Fiqh

Answered by Ustadh Sufyan Qufi

Question

Was just hoping for a fiqh reference for the following fatwa, please. Specifically about nothing being due if underwear is worn during ‘umra for a need. Apologies for the inconvenience, but it is more for self-learning and not an objection:

Do I Have to Pay a Penalty for Using Perfumed Soap While in Ihram?

Answer

In the name of Allah, the Most Compassionate, Most Merciful,

One reference is the Shafi‘i book: ‘Umdat al-Salik by Ahmad Ibn Naqib al-Misri (Allah be pleased with him) and the fact that there is nothing wrong for a Hanafi believer to follow another school when one is faced with genuine hardship.

Ease in Religion

Allah, Most High, says:

“Allah desires ease for you; He does not desire difficulty for you.” [Quran, 2:185]

The Messenger of Allah (Allah bless him and give him peace) has said,

“Those who make things hard for themselves will be destroyed.” [Muslim]

The Prophet (Allah bless him and give him peace) stated,

“None makes the religion difficult except that it overcomes him. So, aim for what is right, stick to the moderate way (…).” [Bukhari]

And Allah knows best.
Wassalam
