Can I Marry a Non-Muslim Woman After Her Conversion and Divorce?

Hanafi Fiqh

Answered by Mawlana Ilyas Patel

Question

I intend to marry a non-Muslim woman who plans to accept Islam and divorce her non-Muslim husband. I seek guidance on whether a verbal divorce suffices if she must observe ‘idda, whether her conversion annuls the marriage, and if I must wait for the court-issued divorce before marrying her.

Answer

In the Name of Allah, the Most Merciful and Compassionate.

I pray you are in good faith and health. Thank you for your question.

You must wait for the court-issued divorce before marrying her. However, she will not have to observe a waiting period (‘idda).

May Allah (Most High) destine what is good for you. Pray two rak‘as of the Prayer of Need, and ask Allah (Most High) to destine what is good (khayr) for you.

Given the considerations in such cases, we urge you to consult reliable local scholars about the specifics of the situation.
