Does a Wife Have the Right to Earn Wealth?
Hanafi Fiqh
Answered by Shaykh Faraz Rabbani
Question
If a husband only provides the basic needs of his wife and prevents her from working, does she still have the right to earn wealth?
Answer
In the Name of Allah, the Merciful and Compassionate.
Outside employment and domestic roles require mutual agreement between spouses, but marriage does not strip a woman of her moral or financial agency. A husband cannot restrict his wife from accumulating independent wealth via home-based businesses, investments, or passive income, and all such earnings belong strictly to her.
Distinguishing Between Two Separate Matters
Two separate matters need to be distinguished here.
The first is whether a woman has the right to earn wealth. The second is whether she should work outside the home, and how that decision is determined within the context of marriage.
Marriage Does Not Remove Moral Agency
Marriage is not a relinquishing of one’s moral capacity or moral agency. There are certain matters that the wife agrees to that fall under the ambit of the marriage.
Mutual Agreement
Household responsibilities and outside work are agreed upon mutually. This includes determining the balance between the wife fulfilling her household responsibilities and any outside work. This should be decided through mutual agreement. One should also consider what had been agreed upon before the marriage.
If the husband and wife are unable to reach a mutual agreement on this, the right thing to do would be to consult reliable, experienced scholars. Beyond that, they should seek counseling if mere consultation does not resolve their issues.
However, the husband cannot limit the wife, outside of her responsibilities, from earning wealth.
For example, if they had agreed that she is not working outside the home, then that would depend on the terms of their agreement. Yet if she wishes to run a business on the side, she can do that, and her earnings are her own.
Similarly, if she has working capital and wishes to invest it or serve as a silent partner in someone’s online business, she has the right to do so.
Handling Disagreements With Care and a Constructive Spirit
One should not leave things hanging. The spirit should be to build relationships and strengthen mutual love, concern, and care for one another, rather than engaging in adversarial dealings with these issues.
And Allah knows best.
