Does a Working Wife Lose Her Right to Nafaqa, and Is She Required to Contribute to Household Expenses?

Question

I heard that if a wife works, she loses her right to financial support (nafaqa) and must contribute to household expenses. Is this correct in Islamic law?

Answer

In the Name of Allah, the Merciful and Compassionate.

No, this is not correct according to the general Hanafi ruling.

A wife does not lose her right to financial support if she works or earns. She is not required to contribute to household expenses just because she has a salary.

The husband remains responsible for providing for his wife: food, clothing, and housing, in a manner that is reasonable and suitable to their circumstances.

Her income remains her own. If she chooses to contribute, it is a kindness and not a duty.

The Basic Hanafi Ruling

A wife’s financial support is due to the husband when she has made herself available within the marital arrangement. Imam Mawsili (Allah have mercy on him) states:

“Maintenance is due for the wife upon her husband when she has submitted herself to him in his home: her maintenance, clothing, and housing, considered according to his state. It is determined by what suffices her, without miserliness or extravagance … If the woman becomes rebellious (nashiza), then she has no maintenance.” [Mawsili, al-Ikhtiyar Sharh
al-Mukhtar]

Allama Abd al-Ghani al-Maydani (Allah have mercy on him) gives the same rule:

“Upon him are her maintenance, clothing, and housing, considered according to both their circumstances, whether the husband is wealthy or poor … If she becomes nashiza, she has no maintenance until she returns to his home.” [Maydani, al-Lubab fi Sharh al-Kitab]

Two key points should be clear:

First, nafaqa is the husband’s responsibility.

Second, a wife does not lose her right to nafaqa because of her wealth, work, or income. The only cause for losing this right is nushuz: when a wife leaves the marital home without right in a way that breaks the basis for financial support.

Working Does Not Cancel Financial Support

Work, by itself, does not mean nushuz.

She Is Not Required to Contribute

A wife is not required to contribute to household expenses from her salary. Her wealth remains hers.

The husband has no right to his wife’s income. Any contribution she makes is voluntary, by agreement, and a kindness.

Between Law And Guidance

It is important to distinguish between what is required by law and what is excellence in conduct.

By law, the husband is responsible for nafaqa. The wife’s income belongs to her.

Morally, spouses should be generous with one another, consult each other, and manage finances with openness.

A wife may choose to contribute. A husband should appreciate his wife’s contribution. Neither spouse should use rights as a weapon or turn marriage into a contest over money.

The best arrangement is one made with clarity, mutual consent, and kindness.

Caveats

Specific cases depend on the details: whether the work was agreed upon before marriage, whether the husband consented, local custom, whether the work is religiously permissible, whether it causes harm, and whether it prevents marital rights.

If there is a dispute, it should be referred to a qualified scholar.
