Does Engaging in Oral Sex With the Same Sex Affect Virginity?
Hanafi Fiqh
Answered by Mawlana Ilyas Patel
Question
This is hypothetical and was asked of a friend. If a Muslim man has engaged in oral sex with someone of the same sex and no penetration occurred, and he realized it was wrong, repented, and stopped the actions, is he no longer a virgin?
Answer
In the Name of Allah, the Most Merciful and Compassionate.
One will still be a virgin, as one’s virginity is only taken away by penetration of the male private part. One should not entertain this type of hypothetical questioning, as it can lead to other things.
A Muslim who engages in sexual acts with someone of the same sex is sinful. He will have to repent sincerely, stop the sin, regret his actions, and resolve not to return to it.
Allah Most High says, “And remember when Lot scolded the men of his people, saying, ‘Do you commit a shameful deed that no man has ever done before? “You lust after men instead of women! You are certainly transgressors.” [Quran, 7:80-81]
If someone intends to sin in this way, he should stop thinking this way immediately, repent, feel regret, and make a resolve not to do so again.
And Allah knows best.
