How Do Heirs Allocate a Deceased Parent’s Undivided Property Share?

Question
My late father had a share in ancestral property that was jointly owned by his siblings, without a formal division. After his death, I took responsibility for handling it. How should the property be divided Islamically among the heirs, given there was no official partition or sale during his lifetime?

I hope you are in good health and faith. Thank you for your question.
Since your father did not sell, divide, or otherwise dispose of his share during his lifetime, his ownership remained intact until his death. Now, as his heir, you cannot sell or claim the entire property—only his inherited share.
Therefore, you and his siblings will need to sit down and determine a fair way for everyone to sell the house, so you can all claim your portions and move forward.
Distribution of Estate
Money from the above, now known as estate (taraka; left over), will be used in the following manner:
- Payment of funeral and burial expenses
- All monetary debts, and any Islamic will (wasiyya) from one-third of the wealth, including religious liabilities like unpaid Zakat, fidya, etc.
- If the deceased made a will (wasiyya), then one-third of the estate can be given to the non-heirs only.
- The remaining assets will be distributed among the inheritors in accordance with Islamic law, under the guidance of a reliable Mufti or scholar. [Sajawandi, al-Siraji fi al-Mirath]
