Is A Wife Sinful For Refusing Return After Divorce?

Question

Why is a husband allowed to take his wife back during the ‘idda of a revocable divorce without her consent? If the husband is abusive and the wife does not want to return, can he force her back into the marriage? Is she sinful if she refuses to go back?

The wisdom of revocable divorce (ruju‘) lies in encouraging reconciliation instead of control. Abuse destroys its moral validity. A husband isn’t legally allowed to force an abused wife to come back. Likewise, if a wife refuses due to harm, she isn’t at fault. The real blame falls on those who misuse Allah’s commands to oppress others.

Don’t Retain Them to Harm Them

The Quran clearly states its limits. Allah explicitly forbids using return as a means of harm.

Allah Most High says,

“When you divorce women, and they have almost reached the end of their waiting period, either retain them honourably or let them go honourably. But do not retain them only to harm them, (or) to take advantage (of them). Whoever does that surely wrongs his own soul. Do not take Allah’s revelations lightly. Remember Allah’s favours upon you as well as the Book and wisdom. He has sent down for your guidance. Be mindful of Allah, and know that Allah has (perfect) knowledge of all things.” [Quran, 2:231]

If a woman fears harm, unfair treatment, or abuse, she might avoid returning to marriage. She should allow her husband a chance to amend, involve reliable  Imams or family members, consider legal separation, ask for khul‘, faskh, or seek protection. Protecting herself isn’t disobedience to Allah but caring for her well-being.
