Is Marketing for a Business That Accepts Conventional Insurance Permissible?

Question

I provide marketing, customer acquisition, and referral services for a business whose services are lawful but accept payment through conventional insurance.

Is my work permissible? When customers ask, may I answer truthfully that insurance is accepted? And may I advertise it?

Answer

In the Name of Allah, the Merciful and Compassionate

Yes, this work is permissible. Marketing a lawful service is itself a lawful service. You conclude no insurance contract: the customer chooses it, the insurer pays, and the business pays you for lawful work.

The Hanafi school looks at where the wrong occurs. When another person’s free choice stands between your work and the wrong, responsibility for the wrong attaches to their act, not to yours.

This is the reasoning the school applies to selling grape juice, which only becomes wine by another’s deed, and it runs through the discussions in the Hidaya and Ibn Abidin’s treatment of hired carriage. [Marghinani, al-Hidaya, 4.378; Ibn Abidin, Radd al-Muhtar, 6.392]

Your marketing promotes a lawful service; the insurance contract, where it happens, is the customer’s and insurer’s own act.

Answering Truthfully Is Not Participation

When someone asks whether insurance is accepted, say yes. Stating a fact about payment methods is not participation in the payment method. Truthfulness here is simply honesty in trade, and honesty in trade is beloved to Allah.

Advertising: Disclose, Do Not Induce

One distinction is worth keeping. Listing insurance as an accepted payment method is standard disclosure, and it is fine.

Making the insurance itself the selling point, urging people toward that contract, moves your speech closer to promoting the contract itself, and godfearingness (taqwa) says step back from that.

Keep the promotion on the service; let the payment details inform rather than urge.
