Question

Is a marriage valid if the wali was intoxicated at the time of the nikah?

Answer

In the Name of Allah, the Most Merciful and Compassionate.

The Effect of Intoxication on Contracts

The Prophet (Allah bless him and give him peace) said:

“There are three matters which, whether said seriously or jokingly, are taken seriously.”

This indicates that certain statements carry legal consequences regardless of whether they are uttered in jest or in seriousness. By extension, a person does not escape legal responsibility simply due to engaging in wrongful behavior, such as intoxication.

Validity of the Marriage Contract

If the integrals and conditions of the marriage contract are fulfilled, then the contract is considered valid.

Intoxication, in itself, does not invalidate the contract if the wali was still able to perform his role in a recognizable and functional manner.

However, if the wali was in such an extreme state of intoxication that he was barely able to speak, unaware of his surroundings, or effectively unconscious, then such a condition would be apparent. In such a case, the contract would not normally proceed.

A Related Principle from Divorce

A related ruling can be seen in the case of divorce. If a person issues a divorce while intoxicated, the ruling depends on the cause of that intoxication.

  • If the intoxication resulted from unlawful use, then the divorce counts.
  • If the intoxication resulted from legitimate medicinal use, then the divorce does not count.

This distinction is recognized in the Shafi‘i school and reflects the principle that unlawful actions do not excuse one from legal consequences.

A similar understanding applies to marriage contracts.
