Is a Deposit-Based Lease Permissible When Facing Urgent Housing Necessity?

Question

I am a Muslim in Chennai. I need to move urgently due to my autistic son’s needs and severe housing discrimination (48 of 55 rentals rejected us for being Muslim). In Chennai, a “lease” model exists where the tenant pays a ₹10–15L deposit, the owner uses it, and the tenant pays minimal monthly maintenance. Does this raise riba concerns?

My non-Muslim in-laws offered to pay the full deposit as a gift for their daughter and grandchild, no repayment required. Practically, the agreement must be in my name as the resident.

My question: Since I am not paying the deposit, does the Riba Concern apply to me? Is living there permissible, given my hardship?

I pray you are in good faith and health. Thank you for your question.

May Allah reward you for striving to ensure that your lease arrangement is Shari‘a-compliant. Your concern to avoid riba is admirable. Indeed, Allah does not allow the reward of the righteous to be lost. [Quran, 12:90]

It is permissible for you to live there.

The Arrangement May Involve Riba

If the deposit is, in reality, a loan given on condition that the borrower leases his property to the lender, then it falls within the ambit of a “sale and condition,” and potentially the riba you are rightly seeking to avoid. Whether your in-laws provide the funds through a gift to your wife and daughter does not alter the fact that the money serves as the principal amount in a usurious transaction.

Although your in-laws provided the deposit, you are the direct beneficiary of the arrangement. The ruling is therefore determined by the nature of the transaction itself rather than by the source of the funds. On this analysis, the arrangement would not be permissible as a matter of strict ruling (azima).

The Principle of Necessity

Given the circumstances you have described, the concession applies. Necessities render prohibited matters permissible. [Suyuti, al-Ashbah wa al-Naza’ir]

It is therefore permissible for you to live there.

A Note on Verifying the Nature of the Lease

That said, you should consult a local scholar, as there may be details that characterize the arrangement as a genuine lease rather than one connected to riba. In that case, the lease would generally be valid as a matter of strict ruling.

Allah Most High says: “And whoever is mindful of Allah, He will make for him a way out and provide for him from where he does not expect.” [Quran, 65:2–3]
