Are witnesses required for a valid talaq in the Hanafi school? Is the divorce valid when witnessed by one man and one woman?

In the Hanafi school, a divorce (talaq) is valid without witnesses.

Divorce takes effect by the husband’s clear utterance — whether anyone is present or not. This is the position of the four Sunni schools and the overwhelming majority of classical scholars. [Mawsuli, al-Ikhtiyar, Kitab al-Talaq; Ibn Abidin, Radd al-Muhtar; Ibn Quadama, al-Mughni; Nawawi, al-Majmu‘ Sharh al-Muhadhdhab]

A divorce witnessed by one man and one woman is valid. It is also valid if no one witnessed it. Witnesses are not a condition for divorce, unlike marriage.

The Quranic Basis

The Quran says, “So when they draw to the end of their term, then retain them honorably or part from them honorably: And have two upright men of you witness it.” [Quran 65:1–2; Keller, The Quran Beheld]

Scholars understand this verse, in light of the Quran and Prophetic teachings, as a recommendation (sunna), not a condition for validity.

Witnesses serve as documentation. They help prevent disputes about whether a divorce took place, when it happened, and in what form.

The Seriousness of Divorce

The true matter is the seriousness of the utterance itself.

The Messenger of Allah (Allah bless him and give him peace) said, “Three things are serious whether spoken in earnest or in jest: marriage, divorce, and the taking back of one’s wife.” [Tirmidhi]

A divorce uttered in anger or in jest still takes effect. The real protection is to avoid uttering it lightly in the first place.

On Validity and Documentation

Consider a divorce as having taken place when the words are clearly spoken. The waiting period (iddah) should then be observed.
