Is It Permissible to Buy a Book, Read It, and Then Return It for a Refund If the Seller Allows Returns?

Hanafi Fiqh

Question

Is it permitted to purchase a book, read it, and then return it for a refund if the seller’s policy allows this?

Answer

In the Name of Allah, Most Merciful and Compassionate.

I pray you are well and in the best of states, by Allah’s grace.

If you do not go against the terms of the contract or the return policy, this is not in itself impermissible.

However, this is not from the way of taqwa, especially if it becomes a habit. The Sacred Law calls us to rise above the bare minimum, seeking truthfulness, good character, and leaving what is doubtful.

The Strict Ruling

If the seller’s return policy truly allows returns after reading, and you are honest about your intent and the book’s condition, then the basic ruling is that it is permitted. Allah Most High commands us to fulfill our binding agreements. When a contract is honored as written, it is honored in the sight of Allah.

But Not From Uprightness

The believer is called higher. The Prophet (Allah bless him and give him peace) said, “The truthful, trustworthy merchant will be with the prophets, the truthful, and the martyrs.” [Tirmidhi, well-authenticated (hasan)]

The Prophet (Allah bless him and give him peace) also said, “Leave what makes you doubt for what does not make you doubt.” [Tirmidhi, rigorously authentic (sahih)]

And he taught the principle of avoiding the doubtful: “The lawful is clear and the unlawful is clear; between them are doubtful matters. Whoever guards himself from the doubtful protects his religion and his honor.” [Bukhari; Muslim]

Buying with the intention of reading and then returning the book, even if the contract allows it, falls into the area of doubt. Making this a habit distances one from uprightness and the way of the people of taqwa.

The Better Path

It is better to borrow from a library or a friend, or to read in-store if that is permitted. Make use of publisher previews when available. Buy what you intend to keep. If you purchase in good faith and the book is not as you expected, then you may use the return policy without hesitation.

Asking Is a Key to Guidance; the Path Is Knowledge

Your asking is itself a sign of care, and a key to guidance. The Prophet (Allah bless him and give him peace) said, “The cure for ignorance is to ask.” [Abu Dawud]

Let this be an invitation to seek knowledge. The SeekersGuidance reader, The Etiquette of Earning a Livelihood, brings together Imam Ghazali’s (Allah have mercy on him) guidance from the Ihya’ ‘Ulum al-Din.

Consider taking a SeekersGuidance course on the prophetic ethics of earning, the Hanafi fiqh of transactions, and the inner meanings of work as worship. Beauty in trade brings blessing to one’s life.

May Allah grant you halal provision, the truthfulness of those beloved to Him, and knowledge that brings beauty to every transaction.

And Allah knows best.
