Is It Permissible to Open a Current Account with an Overdraft Facility?

Question
I want to open a current account, as no Islamic banking options are available. This account provides access to a savings account and includes an optional overdraft facility.
While approval for the overdraft is based on meeting specific qualifications, using the overdraft is not mandatory. Am I sinning by applying for this account?
Answer
In the Name of Allah, the Most Merciful and Compassionate.
I pray you are in good faith and health. May Allah reward you for ensuring your bank accounts are Shari‘a compliant.
Opening a current account is permissible, provided it does not attract interest and the loan amount is mandated, even though it includes an overdraft facility. If no Islamic banking options are available, a regular account would be permitted on the grounds of necessity.
Current Accounts
Current accounts function as loans, not deposits. As a result, the financial institution effectively owns the funds, and a liability to repay the amount is established on its behalf. [See: AAOIFI]
It is permissible as long as no interest is levied on the loan.
Mandate
The account has to be mandated to ensure that:
- The monies are not re-lent on interest
- The funds are not used to finance non-Shari’a-compliant endeavors
Depositing the funds into an account that is not mandated violates the Quran’s injunction,
“And aid one another in devotion to your Lord in every good and godfearingness, and do not aid one another in sin and transgression.” [Quran, 5:2]
Banks inevitably lend out monies at their disposal at interest.
Overdraft
The availability of an overdraft facility presents the potential for riba, nothing more and nothing less. The mere potential for sin does not constitute sin by itself.
Conclusion
Riba is an enormity and should be avoided altogether. Allah says,
“O believers! Fear Allah, and give up outstanding interest if you are (true) believers. If you do not, then beware of a war with Allah and His Messenger! But if you repent, you may retain your principal—neither inflicting nor suffering harm.” [Quran, 2:278-279]
The Shafi‘i approach of applying the Quranic principle of not aiding in sin and transgression to the case at hand manifests Islamic environmental, social, and governance considerations.
