Question

Is a nikah valid without the wali’s approval, and is a woman free to remarry if her husband never issued a talaq but they’ve been separated for ten years, and the civil marriage was annulled?

I pray you are in good faith and health. Thank you for your question.

According to the Hanafi School of thought, a baligha (mature) and sane woman has the right to contract her own nikah without the approval of her wali (guardian), provided she marries someone who is suitable (kuf’). See the link below.

Separation alone does not constitute divorce (talaq) even if a couple has been apart for years. However, if, at some point, civil marriage annulment took place, then according to some scholars, it can count as an Islamic divorce.

Civil Marriage Annulment

Esteemed Muftis and Jurists say that if a husband willingly signs and consents to legal divorce papers, the divorce issued by the court constitutes an Islamic divorce (Talaq), and no further Islamic procedure is needed. However, if the court grants divorce without the husband’s consent, it is not an Islamic divorce, and the wife must seek Islamic annulment (faskh) from a qualified Sharia-certified body.
