Can I Rent My Property to Someone Who Will Commit a Sin There?

Question

I’m considering renting my property to a non-Muslim woman for three months. She has disclosed in advance that her boyfriend will be staying with her for one week during that period.

Given that I have explicit prior knowledge of this, is it permissible for me to enter into this rental agreement?

Answer

I pray this finds you in the best of faith and health. Thank you for your question.

It is permissible for you to enter into the rental agreement outlined above. The disclosed week is subsidiary and thus overlooked. Leniency is afforded to subsidiary matters but not to principal ones. [Suyuti, Ashbah] The rule, ‘Leniency is afforded in subsequent stages but not in the initial stage’, potentially applies to your case as well. [See ibid]

This is similar to the sale of land that has been fertilized with manure. Because the manure is both secondary to the land and necessary, its presence is overlooked. [Dimyati, I’ana]

Rest assured. The above does not constitute assisting in sin and transgression. Aim for what is right and strive to hit the mark. Come as close to perfection as you can when exact attainment is beyond one’s ability.

The Prophet (May Allah bless him and give him peace) said, ‘None of you will be saved by his deeds alone. Rather, strive to do what is right and come as close to perfection as you can.’ They asked, ‘Not even you, O Messenger of Allah?’ He replied, ‘Not even me, unless Allah envelops me in His mercy and grace.
